Terms and Conditions

These Terms and Conditions (hereinafter the "Terms") govern access to and use of the AuPairplus platform (hereinafter the "Platform" or the "Service"), provided by Enrico Danilo Visciola (hereinafter the "Company"). By registering or otherwise using the Platform, the user (Au Pair or Host Family) declares that they have read, understood and fully accepted these Terms. If you do not accept the Terms, you are not permitted to use the Service.
1. Service Description
AuPairplus is an online platform that enables people interested in undertaking an au pair experience ("Au Pairs") and families interested in hosting one ("Families") to create a profile, search for each other and make contact through the internal messaging system.
The Company is not a recruitment agency, employer, marriage agency, tour operator or contractual intermediary. The Service is limited to connecting Au Pairs and Families: the Company does not select, verify, recommend or guarantee any matching, nor does it intervene in any way in the negotiation, conclusion or execution of agreements (host agreements, economic agreements, residence permits, insurance coverage, etc.) that users enter into autonomously with each other. Any relationship established between an Au Pair and a Family is exclusively between those parties, and the Company is entirely uninvolved.
2. Free Service
As of today, use of the Platform is free for registered users. The Company reserves the right to introduce, in the future and with appropriate notice to users, paid features, premium subscriptions or usage limitations for free accounts, without this giving users any right to compensation or damages. Any introduction of paid services will in any case not have retroactive effect on relationships already in progress at the time of introduction.
The Company further reserves the right to suspend, modify or discontinue, in whole or in part and at any time, the availability of the Service (or specific features), even without notice, without this entitling users to any compensation, damages or refunds of any kind, as this is a service provided free of charge.
3. Registration and Account
To use the Service, you must create an account by providing truthful, accurate and up-to-date information. The user is solely responsible for the accuracy of the information entered in their profile and for any consequences arising from false, incomplete or outdated information.
Each user may create only one personal account and may not transfer, share or assign their access credentials to third parties. The user is responsible for keeping their credentials confidential and for all activity conducted through their account.
The Company conducts profile checks (e.g. document verification, moderation) at its discretion, for the purpose of reducing—not eliminating—the risk of fake or fraudulent profiles. A profile marked as "verified" does not constitute a guarantee by the Company regarding the identity, reliability, intentions or suitability of the person, and the user is in any case required to conduct their own independent verification before entering into any agreement with another party.
4. User Obligations and Responsibilities
By using the Platform, the user agrees to:
- provide truthful and non-misleading information in their profile and in communications with other users;
- comply with applicable laws concerning residence, work, immigration, child protection (where relevant) and any other laws applicable to the au pair arrangement in the destination country;
- autonomously enter into the necessary agreements with the other party to govern the stay (including economic conditions, mutual obligations, health insurance and any other relevant aspect), conducting appropriate legal verification on their own behalf;
- not use the Platform for unlawful, harassing, discriminatory, fraudulent or otherwise inappropriate purposes;
- not post offensive, defamatory, discriminatory or infringing content;
- not use the internal messaging or profile content to circumvent the Service by diverting contact to external channels in violation of Platform rules.
5. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by applicable law, the Company does not warrant that:
- the Service will always be available, uninterrupted, timely, secure or error-free;
- information provided by other users is truthful, accurate or complete;
- a matching between an Au Pair and a Family will occur, or that any matching achieved will be satisfactory, safe or meet the user's expectations.
6. Limitation of Liability
To the maximum extent permitted by applicable law, the Company disclaims all responsibility for:
- the behaviour, actions, omissions or statements of any Platform user, whether online or during any meeting, stay or relationship established outside the Platform;
- direct, indirect, incidental, consequential or any other type of damage (including, by way of example, financial damage, personal injury, moral damage) arising from the use or inability to use the Service, or arising from a relationship between an Au Pair and a Family established through the Platform;
- the accuracy, completeness or reliability of content uploaded by users (profiles, messages, photos, reviews);
- interruptions, malfunctions, data loss or unavailability of the Service, even prolonged;
- events beyond the reasonable control of the Company (force majeure, cyber attacks, third-party supplier malfunctions, etc.).
It remains understood that nothing in these Terms is intended to exclude or limit liability that cannot be excluded or limited under applicable law (e.g. liability for fraud or gross negligence, where not derogable).
The user acknowledges and accepts that meeting other people through the Internet, and in particular hosting a person at their home or moving to the home of a third party in another country, inherently involves risks, and that it is the user's exclusive responsibility to take reasonable precautions (e.g. preliminary meetings, reference checks, communication with family members) to protect their safety.
7. User-Generated Content
The user retains ownership of content they upload to the Platform (texts, photos, etc.), but grants the Company a non-exclusive, free and revocable license to use it exclusively for the purposes of operating and promoting the Service. The Company reserves the right to remove, without notice, content that violates these Terms or applicable law, and to suspend or delete the account of the user responsible.
8. Intellectual Property
The name "AuPairplus", the logo, design, software and every other element of the Platform not attributable to user-uploaded content are the property of the Company or their respective licensors and are protected by applicable intellectual property laws. Reproduction, distribution or unauthorized modification of such elements is prohibited.
9. Account Suspension and Termination
The Company reserves the right to suspend or delete, at any time and at its discretion, the account of any user who violates these Terms, provides false information, or behaves in a manner harmful to other users or the Company, without notice and without entitlement to any compensation. The user may request deletion of their account at any time by contacting the Company.
10. Modifications to Terms
The Company reserves the right to modify these Terms at any time. Modifications will be posted on this page with an indication of the last update date. Continued use of the Service following publication of modifications constitutes acceptance thereof.
11. Applicable Law and Jurisdiction
These Terms are governed by Italian law. For any dispute relating to the interpretation, validity or performance of these Terms, the Court of Cassino (FR) shall have exclusive jurisdiction, without prejudice to any non-derogable consumer protection rules that may apply.
